Merlin Jwu - Terms of Service

1. General TermsBy commissioning Merlin Jwu, you agree that you have read, understood, and accepted all terms and conditions outlined in this document.Commission Requests: Submit requests via Email or Twitter / Facebook Direct Message (DM). Contact details will be shared upon approval of your commission request.
Right to Decline: I reserve the right to decline any commission that I am unable to fulfill or that I find uncomfortable.

2. Payment TermsCurrency & Payment Method: All prices are listed in USD, and payments are processed exclusively through PayPal.
Price Variability: Prices are subject to adjustment based on the complexity and specific requirements of the commission.
Additional Fees: Expedited commissions requiring tight deadlines will incur additional charges.
Payment Process: Full payment is required before making the sketch phase. An invoice will be sent via PayPal, and prompt payment is expected.
PayPal Fees: Clients are responsible for covering PayPal transaction fees to ensure the artist receives the full payment.
Private Commissions: Requests for commissions that are not publicly shared will include an additional fee.

Merchandise:                              3x the base price.


3. Timeframe & DeliveryCompletion Time: Standard completion times vary by commission type. Headshot/Portrait & Bust Up commissions generally require 3-5 days.
Health Considerations: Due to personal health conditions, there may be occasional delays. Your understanding and patience are appreciated.
Delivery: All completed artworks are delivered digitally via Email or through a download link.


4. Progress & WIP UpdatesWork-in-Progress Updates: Clients will receive updates at key stages, including the sketch and rendering phases.
Revision Policy: Revisions are accepted during WIP stages. After finalization, additional changes will incur extra fees.


5. Refund PolicyNon-Refundable Commissions: Once a commission has commenced, refunds are not available.
Artist-Initiated Refunds: In the event I am unable to complete the commission, a full refund will be issued.


6. Copyright & Usage RightsArtist's Rights: I retain all rights to the artwork, including the right to display it in portfolios, galleries, or social media, unless otherwise agreed.
Client's Usage Rights: Clients are granted a non-exclusive license for personal use only. Commercial usage requires appropriate licensing fees.
Credit Requirement: When sharing the artwork publicly, proper credit must be given to Merlin Jwu.
Prohibited Uses: Altering, reproducing, or reselling the artwork for profit is prohibited. Additionally, the artwork may not be used in AI generators, NFTs, or other unauthorized platforms. Violation of these terms will result in legal action and blacklisting.


7. ConfidentialityPrivacy Commitment: All personal information, communication, and project details are kept confidential and will not be shared with third parties without prior consent.


8. Amendments & UpdatesTerms Modification: Merlin Jwu reserves the right to update or modify these terms at any time. Significant changes will be communicated to clients.
